TERMS OF SERVICE
OVERVIEW
With effect from 10 February 2021:
These “Terms and Conditions” shall govern your relationship with Dfitzle PTE LTD (“Dfitzle”), including but not limited to, the use of the Dfitzle Website (www.dfitzle.com, the “Website”) to manage your account, bookings, communication, purchases and registration with Dfitzle, the use of and attendance of virtual and in-person Dfitzle classes, as well as online personalised coaching with Dfitzle.
By visiting our site and/ or purchasing something from us, you agree to be bound by the following terms and conditions (“Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.
Dfitzle has the rights to amend the Terms without notice. The Terms may be revised at any time by updating this posting. Dfitzle clients are encouraged to check this document periodically to stay informed of current guidelines.

SECTION 1. CLASS BOOKINGS
All classes need to be booked in advance through the Dfitzle Website, with relevant payments made online at the time of booking. Manual bookings can also be made via email.
For Private Group Training, a booking request would need to be made on the Dfitzle Website.
For Corporate and Event enquiries and bookings, please email hello@dfitzle.com
Reservations can be made up to exactly 14 days prior to the class/ event. That means, if you’re looking to book a class on 31 August, bookings will open on 17 August. Bookings are always encouraged to avoid disappointment.
SECTION 2. PAYMENT POLICY
We accept payments via Stripe which accepts most major credit/debit cards (i.e. Visa, Mastercard, American Express, etc) for all purchases of classes or Class Packs made online on the Dfitzle Website. For all manual bookings, payment can be made through PayNow to Dfitzle Pte. Ltd. (UEN 202032630C). Please keep a screenshot of this for reference. Your Class Pack will initiate on the date of purchase. You can view all class types and class prices on the Dfitzle Website.
You cannot gift your classes, redeem them for cash, or on-sell them outside of Dfitzle. Any classes or Class Packs that have been purchased anywhere other than Dfitzle will not be honoured.
SECTION 3. MODIFICATIONS TO THE SERVICE AND PRICES
All descriptions of services and service pricing are subject to change without notice.
We reserve the right to limit the sales of our services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any services that we offer.
We reserve the right to modify or discontinue the service (or any part or content thereof) without notice at any time. Any offer for any service made on this site is void where prohibited.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the service.
We do not warrant that the quality of any services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the service will be corrected.
SECTION 4. CANCELLATION POLICY
You are able to cancel your class booking without any charges or loss of classes from your Class Pack up until six (6) hours prior to class commencement time for all classes. Should you not cancel class before this time, or simply not show up for the class, a class will be deducted from your active Class Pack or single class purchase.
Cancellations can be made through the Dfitzle Website, or by emailing hello@dfitzle.com at least six (6) hours prior to class commencement time.
SECTION 5. EXPIRY POLICY
Classes and Class Packs do expire. The expiration dates of your Class Packs can be found under the ‘My Bookings > Upcoming’ section of the Website. The validity will also be clearly stated on your Class Pack purchase receipt which you would receive via email. These validities vary based on specific Class Pack. Promotional Class Packs may also carry different validity period. We will send an email notification to the address assigned to your profile 14 days before the expiration of your package.
For Individuals:
Purchased classes are only for the use of the individual that purchased the classes.
We will send a notification out via email 14 days before the expiration of your Class Pack. If, however, you cannot finish your classes within the allotted validity period, Dfitzle will allow up to one (1) validity extensions of two (2) weeks per extension, per package. These extensions must happen when the package is still active within the validity period.
Should your Class Pack expire, we do allow rollover of expired classes into a newly purchased Class Pack, only if this purchase is made within one (1) month after the expiration date of your expired Class Pack. You cannot rollover classes into a Single Class purchase. The validity of rolled over classes will be in line with the stated validity of your newly purchased Class Pack. You cannot rollover a rolled over class. Rollovers and extensions do not apply to the class types listed below:
- “Freebie” Classes
- Rolled Over Classes (“Rollies”)
- 1 Month Pass
- Shareable Class Packs (“Share Packs”)
Should there be special circumstances regarding your ability to complete your package, refer to clause 6.
All Class Pack purchases are final and non-refundable.
For Groups:
Dfitzle requires you to assign a Pack Leader before purchasing the Share Pack. The Pack Leader will have access to complete bookings and cancellation. We will send the Pack Leader a notification via email two (2) weeks before the expiration of the Share Pack. Strictly no extensions or rollovers will be given on any Share Packs.
Please consider your Pack Members carefully, as Dfitzle will not facilitate any negotiation of disputes between Pack Members.
All Class Pack purchases are final and non-refundable.
SECTION 6. SPECIAL CIRCUMSTANCES AND RIGHT TO TRANSFER OF PACKAGE
We will grant a one-time transfer at no additional cost per Class Pack in the sole discretion of Dfitzle. Transfers can only be done before the expiration date of the Class Pack. The validity of the transferred package will not restart, but continue as it is at the time of transfer.
SECTION 7. LATE COMING AND EARLY DEPARTURE
If you are running late for your booked class, we ask that you let us know you are on the way. To avoid disruptions and any compromise to your safety, our staff will have the right to deny you entry if you are more than 10 minutes late for the session. If an early departure is made by choice, your class will not be returned.
For in-person classes, we highly recommend that you plan to be at the location twenty (20) minutes before the start of your class, to cater for any travel challenges.
SECTION 8. GIFT VOUCHERS
You may purchase gift vouchers via email and share it with the intended beneficiary. Gift vouchers come in the form of coupon codes which can be used for classes and Class Packs. Gift vouchers expire six (6) months after purchase. Once a package purchase is made using a gift voucher, it will expire, just like any regular class purchase.
SECTION 9. GIVING BACK
All donations and contributions provided to external organisations as part of our “Giving Back” initiative is completely out of goodwill and we reserve the right to display any proof of donations. In no way does Dfitzle have any affiliation with any of these organisations. For the avoidance of doubt, Dfitzle is not soliciting donations or fundraising on behalf of these organisations.
SECTION 10. LOST OR DAMAGED PERSONAL PROPERTY
For all in-person classes, a designated area is provided for you to leave your personal goods when class is in session. Regardless of care taken to avoid loss, Dfitzle is not liable or responsible for any damage, theft, loss, or destruction of personal property within the Dfitzle facility.
SECTION 11. WAIVER AND RELEASE
Your health is your responsibility. You must ensure you are in good physical condition and know of no medical or other reason why you should not exercise. If unsure, you should not use Dfitzle services until after you have sought appropriate medical guidance and been given the go-ahead.
By signing up for and/or attending classes, online personalised coaching, events, activities, and other programs and using the premises, facilities and equipment (individually and/or collectively, the "Classes and Facilities") of Dfitzle, you hereby acknowledge on behalf of yourself, your heirs, personal representatives and/or assigns, that there are certain inherent risks and dangers in working out at Dfitzle. You acknowledge that some of these risks cannot be eliminated regardless of the care taken to avoid injuries and that Dfitzle and the Dfitzle staff will not be liable for any injury or damage should you choose to participate.
If in the subjective opinion of the Dfitzle staff, you and/or others would be at physical risk using Dfitzle's Classes and Facilities, you may be denied access to the Classes and Facilities.
SECTION 12. DISPUTE RESOLUTION
At Dfitzle, we do our best to make sure you have a great experience every time. Whenever someone purchases a Dfitzle class pack, we feel indebted to that individual by way of excellent service. We do acknowledge that from time to time, our expectations don’t align.
Should this happen, we hope you will give us the opportunity to try to address any challenge you may be facing at Dfitzle. To do that, please e-mail us at hello@dfitzle.com Please include: (1) your name, (2) your address, (3) a description of your concerns, and (4) a description of the specific relief you seek.
Any dispute arising out of or in connection with any agreements pursuant to which we provide you services, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration administered by the Singapore International Arbitration Centre (“SIAC”) in accordance with the Arbitration Rules of the Singapore International Arbitration Centre ("SIAC Rules") for the time being in force, which rules are deemed to be incorporated by reference in this clause.
The seat of the arbitration shall be Singapore. The Tribunal shall consist of one arbitrator.
SECTION 13. LINKS AND THIRD PARTY SITES
Dfitzle has not reviewed all the sites linked to the Website, and is not responsible for the content or any off-site pages or other linked sites. Although a third-party website and/or app may contain the Dfitzle brand name, please understand that it is independent from Dfitzle, and that Dfitzle has no control over the content of that website and/or app. Going to third party or off-site websites from the Website is at your own risk. These links do not imply endorsement of, sponsorship of, or affiliation with Dfitzle.
SECTION 14. INTELLECTUAL PROPERTY RIGHTS
The trademarks of Dfitzle are proprietary to Dfitzle and may not be used by you for any reasons other than as expressly permitted by these Terms. All Website content, design, text, graphics, and interfaces; the collection, selection, and arrangement thereof; and all software are property of, or duly licensed to, Dfitzle. You have the right to view, electronically copy, and print in hard copy portions of the Website for the sole purpose of making class reservations, purchases, or other personal use.
Any other use of materials on the Website, including modification, distribution, or reproduction for purposes other than those noted above, without the prior written permission of Dfitzle, is strictly prohibited.
You acknowledge that Dfitzle and/or third-party content providers remain the owners of all Website materials, and that you do not acquire any of those ownership rights by downloading, copying, or using any such material in accordance with these Terms. Dfitzle may discontinue or remove the Website, or any portion thereof, or discontinue your right to use the Website, or any portion thereof, at any time.
SECTION 15. USE OF SERVICE BY MINORS
If you are under the age of 16, you must seek the permission of a parent or guardian before accessing and/or making any class bookings through the various booking platforms. Minors under the age of 16 are encouraged to exercise alongside a parent or guardian. Refer to clause 11 for our Waiver and Release terms. Dfitzle will not be liable for any misuse of the Dfitzle Website.
SECTION 16. WARRANTY DISCLAIMER AND LIMITATION OF LIABILITY
In no event will Dfitzle be liable for any direct, indirect, special, or other consequential damages resulting from your use of the Website, or on any other linked/third-party website, your purchase of Dfitzle classes, your booking of classes, your communication with Dfitzle, and your use of and attendance at virtual and In-person Dfitzle classes, including without limitation, any lost profits, business interruption, loss of programs, or other data on your information handling systems or otherwise, including any claims waived by you previously in this agreement even if Dfitzle expressly advised of the possibility of such damage.
All information, goods, services, products and experiences are provided by Dfitzle on an "as-is" basis only. The entire risk as to the quality and performance of the goods, services, products and experiences remains with you. Should the goods, services, products and/or experiences prove defective after purchase, you assume the entire cost of such defect. Dfitzle provides no representations and warranties, express or implied, including the implied warranties of fitness for a particular purpose, merchantability, and non-infringement.
SECTION 17. CHOICE OF LAW
These Terms of Service and any agreements pursuant to which we provide you services shall be governed by and construed in accordance with the laws of Singapore.
